Jewish Long Beach reserves the right to cancel an class, activity, or group, in which case a full refund will be made. In the event of a withdrawal BEFORE 5 business days prior to program, partial refund will be made in the amount of 75% of the original fee. REFUNDS WILL NOT BE MADE AFTER 5 business days prior to start of program. Participation in any Jewish Long Beach activity and use of recreational facilities involves a risk of accidental injury despite all safety precautions. Having been informed of the activities conducted by the Jewish Long Beach, I/we as an individual or parent or guardian of the participants named herein, assume all risk and hazards incidental to the activities, and release from responsibility and agree to indemnify and hold harmless Jewish Long Beach, its officers, directors, independent contractors, volunteers, and all employees for any illness or injury to me or my children or family members occurring during his/her/our participation in any activity or use of any recreational facility at or conducted by Jewish Long Beach. Participation in Jewish Long Beach activities constitutes permission for the agency to use any photos of the participant for promotional purposes without remuneration.

In consideration of being permitted to utilize the facilities, services and programs of the Jewish Community Center of Long Beach, Jewish Federation of Greater Long Beach and West Orange County, and Jewish Family and Children’s Services (or my children to so participate) for any purpose, including, but not limited to observation or use of facilities or equipment or participation in any offsite program affiliated with the Jewish Community Center of Long Beach, Jewish Federation of Greater Long Beach and West Orange County, and Jewish Family and Children’s Services, the undersigned for himself or herself and such participating children and any personal representatives, heirs, and next of kin, hereby acknowledges, agrees and represents that he or she has or immediately upon entering or participating will inspect and carefully consider such premises and facilities or the affiliated program. It is further warranted that participation in such affiliated program constitutes and acknowledgement that such premises and all facilities and equipment thereof and such affiliated programs have been inspected and carefully considered and that the undersigned finds and accepts same as being safe and reasonable suited for the purpose of such observation, use or participation by the undersigned and such children.

IN FURTHER CONSIDERATION OF BEING PERMITTED TO ENTER THE JEWISH COMMUNITY CENTER OF LONG BEACH, JEWISH FEDERATION OF GREATER LONG BEACH AND WEST ORANGE COUNTY, AND JEWISH FAMILY AND CHILDREN’S SERVICES FOR ANY PURPOSE INCLUDING BUT NOT LIMITED TO OBSERVATION, USE OF FACILITES OR EQUPIMENT, OR PARTICIPATION IN ANY OFFSITE PROGRAM AFFILIATED WITH THE JEWISH COMMUNITY CENTER OF LONG BEACH, JEWISH FEDERATION OF GREATER LONG BEACH AND WEST ORANGE COUNTY, AND JEWISH FAMILY AND CHILDREN’S SERVICES, THE UNDERSIGNED HEREBY AGREES TO THE FOLLOWING:

THE UNDERSIGNED on his or her behalf and behalf of such children, to the extent permitted by law, HEREBY RELEASES, WAIVES, DISCHARGES, AND CONVENANTS NOT TO SUE the Jewish Community Center of Long Beach, Jewish Federation of Greater Long Beach and West Orange County, and Jewish Family and Children’s Services, its directors, officers, employees, and agents (hereinafter referred to as
the ‘releases’) from all liability to the undersigned or such children and all his personal representatives, assigns, hers, and next of kin for any loss or damage, and any claim or demands therefore in account of injury to the person or property or resulting in death of the undersigned or such children whether caused by the negligence of the releases or otherwise, while the undersigned or such children is
in, upon, or about the premises or any facilities or equipment therein or participating in any program affiliated with the Jewish Community Center of Long Beach, Jewish Federation of Greater Long Beach and West Orange County, and Jewish Family and Children’s Services.

THE UNDERSIGNED, to the extent permitted by law, HEREBY AGREES TO INDEMNIFTY AND SAVE AND HOLD HARMLESS the releases and each of them form any loss, liability, damage or cost they may incur due to the presence of the undersigned or such children in, upon or about the Jewish Community Center of Long Beach, Jewish Federation of Greater Long Beach and West Orange County, and Jewish Family and Children’s Services premises or in any way observing or using any facilities or equipment of the Jewish Community Center
of Long Beach, Jewish Federation of Greater Long Beach and West Orange County, and Jewish Family and Children’s Services or participating in any program affiliated with the Jewish Community Center of Long Beach, Jewish Federation of Greater Long Beach and West Orange County, and Jewish Family and Children’s Services whether caused by negligence of the release or otherwise. THE UNDERSIGNED, to the extent permitted by law, HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE to the undersigned or such children due to the negligence of releases or otherwise while using the premises or any facilities or equipment thereon or participating in any program affiliated with the Jewish Community Center of Long Beach, Jewish Federation of Greater Long Beach and West Orange County, and Jewish Family and Children’s Services.

THE UNDERSIGNED further expressly agrees that the foregoing RELEASE, WAIVER AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

The UNDERISNGED HAS READ AND VOLUNTARILY SIGNS THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT and further agrees that no oral representations, statements or inducement apart from the foregoing written agreement have been made.

Jewish Long Beach (JLB) offers a friendly and comfortable environment for all. As a family facility, we expect all members, guests, and visitors to act within the boundaries of Jewish Long Beach’s core values of honesty, respect, responsibility, and caring. Our Member & Guest Code of Conduct outlines prohibited behavior, but the actions listed below are not an all-inclusive list of behaviors that may be considered inappropriate in our facilities or programs. We ask individuals who enter the facility to always act appropriately and abide by the following policies:

• All persons are required to enter Jewish Long Beach in an authorized manner, using only approved entrances and exits to which they have been granted access, and following proper check-in procedures.
• Aiding in the unauthorized entrance of any person, sharing membership cards for access to the facility or unauthorized access to programs, services or classes is prohibited.
• Members are fully responsible for the conduct of their guests and members must accompany their guests at all times.
• Disruptive behavior is grounds for removal from the Jewish Long Beach property and revocation of facility use privileges without refund. Such behaviors include but are not limited to:
  
  • Aggressive or vulgar language, including swearing, threatening, name-calling or shouting;
  • Physical contact with another person in a malicious, threatening, or unwanted manner;
  • Any demonstration or insinuation of sexual activity or sexual contact with another person;
  • Harassment or intimidation by words, gestures, body language or any menacing behavior;
  • Theft, or behavior that results in destruction of property;
  • Carrying or concealing any weapons, devices or objects that may be used as or perceived as weapons;
  • Smoking or using tobacco products of any kind (including but not limited to vaping or chewing tobacco). The entire JCC campus is a smoke-free and tobacco-free environment;
  • Use or possession of drugs or similar illegal substances on Jewish Long Beach property, in Jewish Long Beach vehicles or at Jewish Long Beach sponsored programs.
  • Use or possession of alcohol on Jewish Long Beach property, in Jewish Long Beach vehicles, or at Jewish Long Beach sponsored programs, except at those programs and events where such use has been authorized in advance in writing by the executive director; Solicitation, gambling, proselytizing or panhandling of any kind is prohibited.
  • Behavior that results in destruction of property.
  • Aiding or abetting in the unauthorized entrance of any person.
  • Taking unauthorized pictures of members or staff.
  • Violation of any law not listed herein is prohibited.
  • Protest, demonstration, or public expression of dissent on JLB property unless organized by Jewish Long Beach.
  • Loitering, or causing annoyance or alarm, to other members or staff.

• Members, guests, and visitors are expected to act and dress in a manner which is in line with our values. Any display of messages or images which are deemed to be in conflict with those values are not permitted. JLB reserves the right to determine at its sole discretion what constitutes a violation of this policy.
• Members, guests, and visitors are expected to comply with all posted signs and staff instructions.
  Children under the age of 13 cannot be left unattended at any time. One adult chaperone is required for every group of 15 children under the age of 13.
• Members, guests, and visitors are restricted from all staff areas (i.e.: courtesy desk, storage areas) and are prohibited from moving equipment (i.e.: pickleball nets). Please ask Jewish Long Beach staff for assistance.
  No one is allowed to conduct business on the premises unless previously agreed to with management and documented in writing.
• All exits and pathways shall remain clear at all times and conform with all municipal, state, and federal safety regulations.
• Persons listed on the National Sex Offender Registry are not permitted on Jewish Long Beach property. Jewish Long Beach has the right to require satisfactory identification and conduct background checks on any individual on its property or in attendance at its programs or events at any time.
• Service animals are permitted inside Jewish Long Beach as per applicable state and federal laws. Jewish Long Beach reserves the right to inquire as to whether a service animal is required for a disability, and what tasks or jobs it has been trained to perform. Service animals must be under control at all times and are not permitted in Jewish Long Beach pools. Animals not meeting the necessary criteria to be service animals are not permitted inside Jewish Long Beach. Animals on Jewish Long Beach’s outdoor property must be on a leash held by a responsible adult at all times, and owners are responsible for cleaning up after them.
  Individuals are permitted to use gender-specific Jewish Long Beach facility areas consistent with their gender identity. Employees are permitted to provide supervision in this process.
• Solicitation, gambling, proselytizing or panhandling of any kind is prohibited.
• Jewish Long Beach reserves the right to search any person and property at any time.

These Terms of Use and other Jewish Long Beach policies may be updated by Jewish Long Beach from time to time. Policy changes are posted to Jewish Long Beach’s website and sent via e-mail. It is the responsibility of each individual to provide a working e-mail address and notify Jewish Long Beach if it changes or otherwise check Jewish Long Beach’s website for policy updates. Violations of any of these rules may result in termination of membership. Jewish Long Beach through its leadership and Board of Directors reserves the right to remove from the premises any individual acting in an inappropriate manner and further reserves the rights for additional disciplinary actions including but not limited to cancellation of membership, or involvement of local law enforcement. Please note: these premises are under 24-hour recorded video surveillance.

Firearms (or any replicas thereof) are prohibited on the Jewish Long Beach Campus, except those carried by active law enforcement (on or off duty). Concealed carry permit holders and retired law enforcement are not allowed to bring in firearms. Non-firearm weapons are covered by a separate policy.

Active-duty law enforcement officers visiting the facilities for non-law enforcement purposes need to follow their agency’s policy on storing and carrying of firearms.

To ensure a safe environment for employees, members, and visitors, Jewish Long Beach prohibits the wearing, transporting, storage, or presence of firearms or other dangerous weapons on Jewish Long Beach property, including all Jewish Long Beach-owned buildings and surrounding areas such as sidewalks, walkways, driveways, and parking lots under Jewish Long Beach ownership or control, and anywhere that Jewish Long Beach business is conducted, such as Jewish Long Beach events taking place off-campus.

For the purpose of this policy, a “dangerous weapon” is any object that is used to inflict physical harm, is intended to be used to inflict harm, or could reasonably cause fear of infliction of harm, including any object that may be deemed a weapon under applicable law.

The determination of whether an item is considered a dangerous weapon will be made on the totality of the circumstances surrounding the item’s possession and use.

Any member or visitor who violates this policy may be removed from the property and reported to legal authorities. Possession of a valid concealed weapons permit is not an exemption under this policy.

Examples of prohibited dangerous weapons include, but are not limited, to:

• Any object from which a projectile may be fired by an explosive
  
• Any simulated firearm operated by gas or compressed air
  
• Ammunition
  
• Explosives
  
• Chemical weapons
  
• Pepper spray
  
• Baton or any object that can be used as a club and poses a reasonable risk of injury
  
• Stun gun
  
• Defensive flashlight
  
• Knives – fixed or locking blade longer than 2.5”
  
• Any spring blade knife
  
• Any knife which opens or is ejected open by an outward, downward thrust or movement
  
• Martial arts weapons
  
• Sling shot
  
• Metal knuckles
  

Any exemption to this policy requires pre-approval.
